“Service Provider”, “we”, or “HookStack” shall refer to Cumulus Creations and its authorised representatives. By booking a shoot with Hookstack, you acknowledge and agree to these terms.
At Hookstack, we operate on a “Factory Model” to ensure speed, quality, and consistency. To maintain our delivery timelines and operational standards, all Client engagements are governed by the following protocols.
1. Booking & Mobilisation
- The 50% Rule: No crew is deployed until a 50% Advance Payment is received. A “Calendar Hold” is not a confirmed booking.
- Deployment Window: We require a minimum of 24 hours notice to deploy a crew. Same-day “Emergency Deployments” attract a 30% Rush Fee.
- Cancellation Policy:
- > 24 Hours Notice: 100% Refund of Advance / Reschedule allowed at no cost.
- < 24 Hours Notice: 50% of the Total Project Value is charged (to compensate the crew who reserved their day).
- On-Site Cancellation: If the crew arrives and the shoot is cancelled by the Client, 100% of the fee applies.
2. On-Site Protocols (Client Responsibilities)
Our crews are strictly “Capture Operators.” They are not cleaners, movers, or stagers.
- “Ready-to-Shoot” State: The location must be cleaned, decluttered, and staged BEFORE our crew arrives.
- Example: If we are shooting a kitchen, the dishes must be done. If the crew has to wait for cleaning, it cuts into your shooting time.
- Point of Contact (POC): The Client must designate ONE single decision-maker on-site. Conflicting instructions from multiple people (e.g., The Architect vs. The Owner) will result in the crew following the POC’s direction only.
- Wait Time & Overtime:
- Our packages are time-capped (e.g., 4 Hours).
- The clock starts at the confirmed Call Time, not when you arrive.
- Delays caused by the Client (e.g., “Key holder is late”) count towards the shoot time.
- Overtime: Charged at ₹2,000 per hour per crew member.
- Talent and Wardrobe:
- Unless explicitly stated in a custom “Casting Add-on,” Hookstack is not responsible for sourcing, booking, or paying for on-screen talent (models, actors, influencers) or hair/makeup artists.
- If the Client provides talent, the Client guarantees that all necessary Model Release Forms have been signed.
Delays caused by Client-provided talent (e.g., late arrival, wardrobe issues) will count toward the booked shoot hours.
3. Creative & Revision Policy
We edit for performance, not vanity.
- The Brief: The “Scope of Work” is defined by the Booking Form. Requests made on-site (“Can you also film my other office nearby?”) are considered Add-Ons and billed separately.
- Revision Rounds: All packages include Two (2) Rounds of Revisions.
- Round 1: Structural changes (Cut this scene, swap this shot).
- Round 2: Fine-tuning (Music volume, text colour, spell checks).
- Round 3+: Billed at ₹1,000 per asset per revision round.
- Music Selection: We use licensed, royalty-free music suitable for social media. We cannot use copyrighted commercial tracks (e.g., Drake, Taylor Swift) unless the Client provides the license.
4. Deliverables & Data Retention
- Raw Footage: Raw footage is NOT included in standard packages. It is the Intellectual Property of Hookstack. If you require the Raw Files (Sony S-Log/4K), this can be purchased for a Buyout Fee (₹15,000).
- Watermarks: All draft videos will contain a “Hookstack Preview” watermark. This is removed only after 100% Payment Settlement. Interest of 2% per month will be charged on invoices pending beyond 7 days of the final delivery date.”
- Turnaround Time: The 48-hour delivery clock starts only after the shoot is wrapped and all assets (logos/briefs) are received from the Client. While we strive for speed, the 48-hour delivery timeline is an estimate based on standard workflow. Hookstack is not liable for consequential damages (e.g., lost ad revenue) caused by minor delivery delays. In the event of a delay exceeding 7 days, the maximum liability is limited to a refund of the specific asset’s value.
- Data Archiving:
- Edited Finals: Stored for 6 months.
- Raw Footage: Stored for 30 days post-delivery. After 30 days, our servers automatically purge the data to free up space. We are not liable for files requested after this window.
- Turnaround Time: The 48-hour delivery clock starts only after the shoot is wrapped and all assets (logos/briefs) are received from the Client.
5. Code of Conduct
- Zero Tolerance: We maintain a professional, safe environment for our Crew and Production Assistants.
- Harassment: Any verbal abuse, harassment, or unsafe working conditions will result in the immediate withdrawal of our crew. The Client will be liable for the full payment, and no assets will be delivered.
- Anti-Poaching: Attempting to hire Hookstack freelancers directly (“cutting out the platform”) is a violation of our terms and will result in a permanent blacklist from our service.
6. Copyright & Usage
- Usage Rights: Upon final payment, the Client is granted a perpetual, worldwide license to use the Final Video for digital marketing (Social Media, Website, Ads).
- Portfolio Rights: Hookstack reserves the right to use the final video (or behind-the-scenes footage) for our own portfolio and marketing purposes, unless a Non-Disclosure Agreement (NDA) is signed prior to the shoot.
7. Social Media Collaboration & Credits
We believe in mutual growth. When your content wins, we win.
- The “Collaborator” Protocol:
- For all social media posts (Instagram Reels/LinkedIn) utilizing Hookstack assets, the Client agrees to add @Hookstack (or your handle) as a “Invite Collaborator” tag.
- Why: This allows the video to be seen by both our audiences, significantly increasing the view count and engagement for your brand.
- Caption Credits:
- If a “Collaborator” invite is not possible, the Client must visibly tag “Video Partner: @Hookstack” in the first 3 lines of the caption.
- Resharing Rights:
- Hookstack guarantees to accept the Collaboration invite within 2 hours of posting, giving your brand immediate exposure to our network of investors, builders, and high-net-worth individuals.
- Removal of Credit:
- Deliberately removing credits or claiming in-house production for Hookstack-produced assets is a violation of our Usage Policy.
8. Liability & Equipment Safety
8.1. Client Property: While Hookstack crews exercise extreme caution, our liability for accidental damage to Client property (e.g., furniture, decor) is strictly limited to cases of proven gross negligence. We strongly recommend Clients remove fragile or high-value items from the shooting zone prior to our arrival.
8.2. Hookstack Equipment: If Hookstack equipment (Cameras, Lights, Audio gear) is damaged due to the actions of the Client, their staff, or animals on-site, the Client is liable for 100% of the repair or replacement cost of the specific gear.
9. Data Integrity & Technical Failure
9.1. The Risk: In rare events of hardware failure (SD Card corruption, SSD crash), data may be compromised.
9.2. Limitation: Hookstack is NOT liable for any consequential damages, lost revenue, or “loss of brand impact” resulting from missing footage.
9.3. The Remedy: In the event of total or partial footage loss due to technical failure on our end:
- (a) Hookstack will provide a Free Reshoot of the missing portions at the earliest available date; OR
- (b) If a reshoot is not possible (e.g., a live event), Hookstack will issue a Full Refund of the specific package fee.
10. Reshoot Policy
10.1. Technical Reshoot (Complimentary): If the footage is unusable due to Hookstack’s error (e.g., focus issues, audio distortion, incorrect settings), we will schedule a reshoot immediately at no cost.
10.2. Creative Reshoot (Billable): Reshoots requested due to Client preference (e.g., wardrobe changes, script changes, weather dissatisfaction, or subjective dislike of the approved location) are billable at 70% of the original package cost.
11. Limitation of Liability (Sole Proprietorship Clause)
11.1. Liability Cap: To the maximum extent permitted by Indian Law, the total liability of Cumulus Creations (Brand: Hookstack), its proprietor, employees, or freelancers, for any claim arising out of this agreement, shall be strictly limited to the total amount paid by the Client for the specific project in dispute.
11.2. No Consequential Damages: Under no circumstances shall Cumulus Creations/Hookstack be liable for any indirect, special, or consequential damages, including but not limited to loss of profit, loss of brand reputation, or loss of business opportunity, even if advised of the possibility of such damages.
12. Indemnification
The Client agrees to indemnify, defend, and hold harmless Cumulus Creations, its proprietor, and its crew from any lawsuits, claims, or legal costs arising from:
- (a) The Client’s failure to secure necessary location permits or property permissions.
- (b) The use of any logos, music, or assets provided by the Client that infringe on third-party copyrights.
- (c) Any injury or property damage caused by the Client or their staff during the shoot.
13. Artistic Discretion
Video production is an artistic process. While Hookstack adheres to the Technical SOPs and the agreed-upon brief, the Client acknowledges that Artistic Discretion (including editing style, color grading tone, and music choice) lies with Hookstack. Subjective dissatisfaction with the artistic style is not valid grounds for a refund or legal dispute, provided the video meets the technical specifications.
14. Force Majeure
Hookstack shall not be liable for any delay or failure to deliver caused by events beyond our reasonable control, including but not limited to: Acts of God, severe weather conditions (monsoons), government lockdowns, political strikes (Bandhs), or sudden illness of key crew members. In such cases, the shoot will be rescheduled to the earliest available date without penalty.
15. Jurisdiction & Dispute Resolution
This Agreement is governed by the laws of India. In the event of any disputes with Cumulus Creations that cannot be resolved amicably within 30 days, the exclusive jurisdiction shall lie solely with the courts located in Hyderabad, Telangana. The Client explicitly waives the right to file legal proceedings in any other jurisdiction.
